These terms apply when you buy a document from instantswms.com.au, operated by [REGISTERED ENTITY NAME] (ABN [ABN]). By completing a purchase you agree to them.
What you receive
An editable Microsoft Word document covering the activity you selected, prepared against the work health and safety legislation in force in the state you selected at checkout. It is emailed to you after payment and can be re-downloaded up to five times within thirty days. We will reset an expired link on request.
Price and payment
Prices are in Australian dollars and are one-off. There is no subscription and nothing recurring. Payment is processed by Stripe.
How you may use it
You may use the document within your own business, including:
- editing it to suit your site, plant, substances and crew;
- reproducing it for your own workers and your principal contractor;
- submitting it to a builder’s compliance portal.
You may not:
- resell, sublicence or distribute it as a template to others;
- publish it publicly or include it in a competing product;
- remove or obscure ownership notices in the file.
Your responsibilities
The document is a template, not a completed site-specific SWMS. Before the work starts you must review it against your actual conditions, complete the site-specific detail, consult your workers as the WHS legislation requires, and brief everyone doing the work. You remain responsible for compliance at your workplace.
What we do not provide
We are not your lawyers and we do not provide legal advice. We do not warrant that a document will be accepted by any particular principal contractor, regulator or portal, or that it covers site conditions you have not told us about. To the extent permitted by law our liability for any claim connected with a document is limited to re-supplying it or refunding what you paid for it.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.
